1. If you are the direct recipient of a direction or remedial direction, you can make an application to the Minister for Home Affairs to vary or cancel it no later than 30 days after the direction or remedial direction was given.

2. If you are the proprietor of a Proscribed Online Location, you can make an application to the Minister for Home Affairs to vary or cancel a declaration of Proscribed Online Location no later than 30 days after the declaration was given. You are deemed to be the proprietor of an online location if you develop and maintain the online location, manage or supervise its use, or exercise editorial control over the online location.

3. A direction, remedial direction or declaration remains in effect, despite any application made, until it is varied or cancelled (as the case may be).

4. To make the application to Minister for Home Affairs, the Form for Application for Reconsideration must be filled out in full, unless otherwise indicated, and:

   1. Sent to FICA_Directions@mha.gov.sg; and

   2. Indicate “Application to Minister for Reconsideration” in the subject title of the email.

6. If you are unable to fill in the form, please write to FICA_Directions@mha.gov.sg with all the details and attachment(s) as required in Regulation 11 of the Foreign Interference (Countermeasures) (Harmful Online Communications Activity) Regulations 2022 .

7. Please attach the direction, remedial direction or declaration together with your application. If a copy is not available, please identify the relevant direction, remedial direction or declaration clearly, such as by providing the reference number, title and date of direction.

8. A notice of the Minister’s decision will be conveyed to you following the completion of the reconsideration process, at the relevant email address.

9. If your application has been refused, and you wish to appeal against the Minister’s decision, you may file an appeal to the Reviewing Tribunal no later than 30 days after the notice of Minister’s decision. For more information on how to file the appeal, please see Information on Appeals to the Reviewing Tribunal below.

1. If you receive a FICA direction or declaration, you can appeal to the FICA Reviewing Tribunal only after both of the following have occurred:

   1. You have submitted a reconsideration application to the Minister for Home Affairs to vary or cancel the FICA direction or declaration ; and

   2. The Minister for Home Affairs has rejected your reconsideration application.

2. You must file the appeal to the Reviewing Tribunal no later than 30 days after the notice of Minister’s decision to your reconsideration application was given.

Fees

3. You are required to pay a fee of $200 for each appeal to the Reviewing Tribunal.

4. Payment can be made via Bank Transfer or PayNow.

5. Please write in to Secretariat@ficatribunal.gov.sg for the payment instructions of appeal fees. This is mandatory and only completed appeal forms with verified proof of payment will be processed.

7. The appeal form must be filled out in full and submitted via e-mail to Secretariat@ficatribunal.gov.sg.

Individuals or organisations who wish to challenge their designations (under Part 4 of FICA) or directives issued to them (under Parts 5 – 6 of FICA) can appeal to the Minister for Home Affairs. An appeal must be addressed to the “Appeals Secretary” and sent either by email to MHA_PDD_RRP@mha.gov.sg or by registered post addressed to the Minister for Home Affairs, Ministry of Home Affairs, New Phoenix Park, 28 Irrawaddy Road, Singapore 329560. The Minister for Home Affairs may consult an advisory committee when he hears appeals regarding designations and directives.
