MHA's response to media queries on Singapore Courts' Facebook post
15 October 2026
In response to media queries on the Singapore Court's Facebook post on CNA's article titled "CNA Explains: What happens when the government disagrees with the courts?" on 15 Oct, MHA has responded as follows:
The Court in Mohamed Erzan Taib Zohri v Public Prosecutor and other appeals [2026] SGHC 183 interpreted the legislation in a manner inconsistent with Parliament’s intention. The Westminster system contemplates that Parliament, in such a situation, can pass legislation to make clear that the Court’s decision is inconsistent with Parliament’s intention.
The sentencing power of the Courts is conferred by Parliament.
The Government has stated in Parliament, on 6 October 2026, that it will be tabling legislation, very soon, that the High Court decision is not to be applied or followed.
